If you are a property owner and leave wet leaves on your sidewalk and someone slips and falls, are you going to get sued?
If you are a residential property owner, probably not.
However, if you are a business property owner, and a customer slips and falls and gets seriously injured, then you may get sued.
As a business owner, you have an obligation to make a reasonable inspection to uncover any dangerous condition and then either eliminate the condition or warn about it. Failing to live up to this obligation make you Negligent and can result in a Lawsuit for Damages.
You know that wet leaves can be slippery and dangerous, so in the Fall, you should make a reasonable attempt to keep your sidewalk clear of fallen leaves. If you do not, and allow wet leaves to accumulate and create a dangerous condition and someone gets hurt, then you might get sued.
Your defense lawyer would still have the ability to argue that the injured person fell on an obvious condition and should have been more careful, but the best way not to get sued is to act reasonably and make an effort to keep your property safe.
It can prevent lawsuits and generate goodwill with your customers!
