Should You Choose Full Tort or Limited Tort on Your Pennsylvania Car Insurance?
One of the most important choices you make when you buy a car insurance in Pennsylvania is whether you choose Full Tort or Limited Tort.
Full Tort costs more money in premiums, but protects your full legal rights to compensation after a car accident caused by someone else. You can claim compensation for economic damages, like medical bills and lost wages, but can also claim noneconomic damages for things like pain and suffering and the negative impact that the injuries have on your life and activities.
With Limited Tort you pay a reduced car insurance premium, but in exchange for reduced cost, you sacrifice important legal rights. You still are able to recover economic damages after a car accident caused by somebody else, but waive your rights to recover noneconomic damages unless you suffer a serious injury which is defined as death, serious and permanent disfigurement or serious impairment body function.
Limited Tort seriously limits your legal rights and, therefore, it’s something that you should think about carefully before opting into.
Many times in my legal career I have consulted with someone who has Limited Tort and they are almost always very surprised and disappointed by the consequences of their Limited Tort election.
