It’s hard for Pennsylvania Car Accident Attorneys to take risky cases.  The method by which we are compensated, a Contingent Fee Agreement, provides that our Fee is Contingent on winning.  If we don’t win, we don’t get paid.  Because of this arrangement, many Pennsylvania Car Accident Lawyers won’t take risky cases.  Instead, they  insist on taking only cases they they know they’ll win.

I try to be different than other Pennsylvania Car Accident Lawyers.  Although I certainly can’t and won’t take on every client wo walks in the door, I do my best to try to be as aggressive as possible to make sure that Pennsylvania Car Accident victims receive fair compensation from insurance companies.

This year I had a nice result for a client that I’m very proud of and it came in a case where both the insurance company for the other driver and the previous lawyer for my client had rejected the case.

My client was injured in a car accident in Chester County and it was clear the other driver was at fault.  What was unclear and disputed was the extent of my client’s injuries.  His medical treatment was delayed and serious neck injuries that required surgery were not diagnosed until months after the collision.

This delay allowed the insurance company to deny that the injuries were caused by the accident and resulted in my client’s lawyer at the time dropping the case.

This may have been the end of the story had the client not come to my office.

Instead of doubting the causation of the injuries and being conservative by sending him on his way, I decided to take a deeper look at the case and have an expert view the records and diagnostic films.  I retained a Radiologist who studied the records and films and concluded that the neck injuries were, in fact, caused by the trauma of the collision.  With this credible opinion, I was able to convince both the insurance company for the other driver and my client’s own Underinsurance carrier to pay policy limits which resulted in a $45,000 compensation award to my client.

In this case, taking a risk and going the extra mile for a client paid off.
